So, you hired all those actors as Independent Contractors and suddenly you owe several thousand dollars in back taxes!? Or, what’s the litmus test on this issue: 
Should you bring on your favorite cameraperson as an employee?
 
* Are you paying by the hour?
 
* Are you using the same person on an on-going basis?
 
* Does the worker have a website?
 
* Does the worker have a dba certificate?
 
* Does the worker have specialized equipment?
 

These are just a few of the questions to see if someone is “In Business” or should be considered “In House.” It’s a big issue that could cost you big bucks.

Do you ever wonder if you should become a corporation or stay a sole proprietorship!? What are the pros and cons of going corporate? You probably knew that if you are a freelance photographer or writer, a craftsperson who takes jobs on a contract basis you are automatically a sole proprietor. But you need to be careful, because a sole proprietor can be held personally liable for any business-related obligation. If you don’t pay a supplier, default on a debt, or lose a lawsuit, the creditor can legally come after your personal stuff. Will incorporating stop that from happening? Is it the right thing for YOU?

Join us this month for some timely tax and legal advice from two experienced and engaging speakers. Nikki Dell’Ara, San Diego Business Law, focuses on corporate and taxation law and will give us the scoop on incorporation. David Branfman is MCA-I's favorite attorney - owner of the Branfman Law Group. Their specialties include transactions and litigation pertaining to intellectual property (“IP”), e-commerce, entertainment matters, and new media. David will help us step through the mine field that is employee vs. independent contractor.
